Introduction

  • We don’t store personal information on our servers unless required for our products' ongoing operations and/or maintenance.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms of Service, accessible from Terms of Service

How we collect your information

When you install our app and use our services, we collect personal information. The ways we collect it can be broadly categorized into the following:

Information you disclose to us

When you register on the services, express an interest in learning more about us or our products and services, take part in activities on the services, or contact us in any other way, you directly give us personal information.

The personal information we collect may include the following:

  • Contact or authentication data

If you make purchases, we additionally gather the information required to process your payment, including your payment instrument number (such as a credit card number) and the security code linked to your payment instrument. Information automatically collected

We automatically collect certain information when you access, utilize, or navigate the services. Your IP address, browser and device characteristics, operating system, preferred language, referring URLs, device name, country, location, information about how and when you use our products and services, and other technical information may be included in this information even though it does not specifically identify you (like your name or contact information). This information is useful for us as it helps us get a better understanding of how you are using our products and services so that we can continue to provide the best experience possible.

Information we get from third parties

The majority of the data we get comes from you directly. In some cases, we may obtain personal information about you from other sources, such as publicly accessible documents or reliable third parties like our research or marketing partners.

How we use your information

We use your personal information for a variety of reasons, depending on how you interact with our Services, including:

How we share your information

BearPop discloses potentially personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on BearPop’s behalf or to provide services available at BearPop’s websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using BearPop’s websites, you consent to the transfer of such information to them.

BearPop will not rent or sell potentially personally-identifying information to anyone.

Other than to its employees, contractors and affiliated organizations, as described above, BearPop discloses potentially personally-identifying information only in response to a subpoena, court order or other governmental request, or when BearPop believes in good faith that disclosure is reasonably necessary to protect the property or rights of BearPop, third parties or the public at large.

If you are a registered user of BearPop’s website and have supplied your email address, BearPop may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with our products. We primarily use our various product blogs to communicate this type of information, so we expect to keep this type of email to a minimum.

If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users.

We take all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information, as discussed below.

How we protect your information

We are committed to preserving your personal information, and we have taken efforts to keep it secure and guard against dangers including unauthorized access, collection, use, disclosure, copying, alteration, and disposal, in particular:

  • We encrypt many of our services using SSL.
  • We review our information collection, storage, and processing procedures, including physical security measures, to guard against unauthorized access to systems.
  • We restrict access to personal information to BearPop employees, contractors, and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

We endeavor to restrict legitimate users' access to the site in an effort to establish a safe and secure environment, but we cannot guarantee that unauthorized users won't acquire access. We expressly disclaim all liability resulting from any unauthorized access to your personal information, to the extent permitted by relevant law.

Unless the risk to your particular rights and freedoms is low - for instance, if the compromised material was properly encrypted - we will notify you without undue delay.

Please contact us if you become aware of any unauthorized use of your account by anyone else or any other breach of security.

Your rights

In accordance with the applicable legislation, you are entitled to a number of rights when your personal data is processed. We will not charge you more or provide you with a lower level of service if you exercise any of these rights.

Subject to the conditions applicable to the exercise of these rights, you have a:

  • Right of access: You have the right to obtain from BearPop confirmation as to whether or not personal data are being processed, and where they are, to receive a copy of all the data that we hold about you.
  • Right to the portability of personal data: you can receive from BearPop, personal data about you in a structured format commonly used and readable by machine, in particular for the purpose of transmission to a third party. Where technically possible, you also have the right to have your personal data transmitted directly to that third party.
  • Right of rectification: you have the right to request the rectification of personal data from BearPop, as soon as possible, if these data are incomplete or incorrect.
  • Right to object: you have the right to object at any time to the processing of your data, unless there are legitimate or compelling reasons for the processing of your data or for the establishment, exercise or defense of legal claims by BearPop.
  • Right to restrict processing: the right to request BearPop to restrict the processing of personal data.
  • Right to erase personal data: subject to certain conditions detailed in Article 17 of the GDPR, you have the right to obtain from BearPop the erasure of your personal data.
  • Post-mortem right: you have the right to give instructions on the fate of your personal data after your death.

Additionally, if you are not happy with our response to a request, you can contact us at support@bearpop.io to resolve the issue. You also have the right to contact your local data protection or privacy authority at any time.

Retention

We will retain your personal information for as long as we have a relationship with you (for example, for as long as you link your Shopify account with us) and for a period of time afterwards where we have an ongoing business need to retain it, in accordance with our data retention policies and practices.

Please note that if you ask us to stop processing your personal information in a certain way or erase your personal data, and this type of processing or information is needed to facilitate your use of the services, you may not be able to use the services as you did before, or at all.

Business Acquisition

If BearPop, or substantially all of its assets were acquired, or in the unlikely event that BearPop goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of BearPop may continue to use your personal information as set forth in this policy.

Cookies and other tracking technologies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. We use cookies to help BearPop identify and track visitors, their usage of our website, and their website access preferences. BearPop visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using our websites, with the drawback that certain features of our websites may not function properly without the aid of cookies.

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
